Protect your brand with Trademark Registration in India
Your brand name, logo and tagline are often the most valuable things you own. A registered trademark is what stops someone else from using them — and what lets you use the ® symbol with confidence.
one-startup is a private consultancy, not a government body. Trademark applications can be filed directly on the IP India portal; our fee is for expert assistance and is separate from the statutory government fee per class.

What is a trademark & do you actually need one?
The essentials in under a minute — so you know what you can protect and what it will take.
Check my requirementWhat a trademark really is
A trademark is any mark that distinguishes your goods or services from someone else's — a brand name, logo, tagline, or a combination. Registration under the Trade Marks Act, 1999 gives you exclusive rights to use it for the classes you register in, and a legal basis to stop copycats.
Who should register
Any business trading under a distinctive name or logo. Sellers on marketplaces — many brand-registry programmes require a trademark. Startups raising funds, where investors check IP ownership in diligence. Anyone who has invested in a name they cannot afford to lose.
How long it takes
You can usually start using the TM symbol within days of filing. Full registration typically takes about 12 to 24 months if there is no objection or opposition, since the application must pass examination, journal publication and the opposition window.
What it costs
The government fee is ₹4,500 per class for individuals, startups, small enterprises and MSMEs, and ₹9,000 per class for other applicants when filed online. Professional fees at one-startup start from ₹1,499 per class, on top of the government fee.
Simple pricing, zero surprises
No confusing packages — just clear professional fees for expert help. Government fee per class is charged separately at actuals:
Our professional fee is the same for all applicant types. Government fees depend on your eligibility and are charged per mark per class. Registration is subject to examination and approval. Examination replies, hearings, opposition proceedings and renewals are not included.
Why registering your trademark early is worth doing right?
It secures your brand name before someone else claims it, unlocks marketplace brand registries, and turns your brand into an asset you can license, sell or defend.
A registered trademark is a legal asset. Done right, it lets you:
Done wrong — the wrong class, a descriptive name with no distinctiveness, or a search never run — and you spend a year in objections or lose the mark entirely. That is exactly why we search before we file.
What you'll need to apply
Trademark filing needs surprisingly few documents — but the details on them have to be exactly right.
Applicant identity proof
PAN and Aadhaar for individuals and proprietors, or Certificate of Incorporation for companies and LLPs.
The mark itself
A clear image of your logo, or the exact wordmark you want to protect, in the form you actually use it.
Form TM-48
A power of attorney authorising us to file and represent your application before the Registry.
Business proof
GST certificate, Udyam certificate or incorporation documents, which also establish eligibility for the lower fee.
Proof of first use
Invoices, packaging or advertisements, if you are claiming use of the mark from an earlier date.
Goods & services list
A clear description of what you sell, which decides your class — the single most important choice in the whole application.
From brand name to ® in 6 steps
From your first message to your registration certificate — clear, tracked, and handled end to end.
Free trademark search
We check the Registry and common-law sources to see whether your mark is available and how risky it is.
Class & strategy advice
We identify the right class or classes for what you actually sell, and advise on wordmark versus logo filing.
Document collection
We collect your identity proof, the mark image, TM-48 and any evidence of prior use.
TM-A filing
We file your application online and share the application number, so you can start using the ™ symbol right away.
Examination & objections
If the Registry raises an examination report, we draft and file the reply and appear for the hearing if required.
Publication & registration
Your mark is published in the Trade Marks Journal. If unopposed, the registration certificate is issued and you can use ®.
What happens after you file your application?
Filing is the beginning of a long queue, not the end. Knowing the stages keeps you calm when the first letter arrives.
Examination report
The Registry raises objections, if any, on distinctiveness or conflicting marks.
Reply & hearing
A written reply is filed, followed by a hearing before the examiner if needed.
Journal publication
The mark is published, opening a four-month window for third-party opposition.
Registration & renewal
The certificate is issued and the mark stays valid for ten years, renewable indefinitely.
Simple rule: respond to every Registry communication within its deadline — silence is treated as abandonment.
Beyond registration — all your brand protection needs in one place

What's changed in 2026 — and why it's easier to get wrong
Filing is faster and almost entirely online, but examination has become stricter on distinctiveness and class accuracy.
Faster examination
Examination reports are now issued far more quickly than a few years ago, which means less time to prepare a reply.
Distinctiveness is scrutinised harder
Descriptive or generic names are objected to routinely. Invented and arbitrary marks clear examination far more easily.
Class accuracy matters more
A vague or over-broad goods description attracts objections. Registration only protects the classes you actually filed in.
MSME and startup fee concession
Individuals, startups, small enterprises and MSMEs pay the lower government fee per class — but you must hold valid proof at the time of filing.
Filing a trademark is cheap. Filing the wrong mark in the wrong class, with no search behind it, is expensive — because the government fee is non-refundable. That is exactly where a search-before-filing service pays for itself.
